Statement on House Victory in McGahn Case

Washington, D.C. – Speaker Nancy Pelosi issued this statement after the full U.S. Court of Appeals for the D.C. Circuit held, 7 to 2, that the House Judiciary Committee has standing to pursue its litigation to enforce its subpoena compelling former White House Counsel Don McGahn to testify:

“Today’s en banc ruling is a victory for the rule of law and Congressional oversight.  The Court reaffirmed our Constitution’s system of checks and balances and rejected the President’s outrageous claim that Congress cannot enforce its subpoenas. 

“In the majority opinion, the Court found that, ‘effective functioning of the Legislative Branch critically depends on the legislative prerogative to obtain information, and constitutional structure and historical practice support judicial enforcement of congressional subpoenas when necessary.’  Yet, the Trump Administration continues to engage in a wholesale obstruction of Congress and flagrantly denies the American people the truth to which they are entitled.      

“The House will continue to pursue justice until Don McGahn and all Administration officials comply with our rightfully-issued subpoenas.  We remain committed to our oversight responsibilities and to our nation’s fundamental principle that no one is above the law – not even the President.”
